These Terms & Conditions explain how the Winky Beauty business-to-business website and enquiry routes may be used. This website is intended for professional buyers who want to review product information, organise sourcing questions and request a catalogue or quotation review.
1. Website information and enquiries
Product pages, guides, images and other website content are provided for general B2B sourcing information. They do not constitute a binding offer, confirmed order, warranty or contract. Product availability, specifications, quantities, private-label options, packaging, samples, pricing, payment arrangements, shipping, delivery timing and other commercial details are confirmed only through a written quotation, Proforma Invoice (“P.I.”), order confirmation or other written project document issued for the specific enquiry.
2. Written quotations and orders
A quotation, P.I. or order confirmation applies only to the product, specification, quantity, destination and commercial terms stated in that document. An order becomes binding only after Winky Beauty and the Buyer have provided the required written confirmation. Payment method, payment timing, production schedule, delivery arrangement and any project-specific conditions will be stated in the applicable P.I. or written order document.
3. Product information and project review
Website content may help you prepare a brief, but project-specific statements require review. Any minimum order quantity, turnaround time, packaging route, sample plan, production method, documentation request or delivery estimate must be confirmed for the actual project. A catalogue reference or earlier discussion is not confirmation for a new order unless it is included in the current written quotation, P.I. or order confirmation.
4. Samples
Subject to product availability and Winky Beauty’s written confirmation, Winky Beauty may provide up to two boxes of product samples without a product charge for an approved sample request. Any destination-specific charges, including import duties, taxes, customs clearance, local handling, storage and onward delivery, are the Buyer’s responsibility unless the applicable written document expressly states otherwise.
5. Delivery, transport, taxes and destination charges
Unless a written quotation, P.I. or order confirmation states otherwise, Winky Beauty is responsible for the agreed China-side manufacturing, delivery, transport and taxes. Charges arising after the goods arrive in the Buyer’s destination country or region are the Buyer’s responsibility. These may include import duties, VAT, GST, customs clearance, local handling, storage, onward delivery and other destination-side charges. Any applicable shipping route, trade term, transfer of risk and delivery location must be confirmed in the project-specific written document.
6. Private-label and customised products
Private-label, branded, customised or made-to-order products are prepared for the Buyer’s requested project. Except where there is a verified quality issue, these products are not eligible for return, exchange or refund. The Buyer is responsible for reviewing and approving any specifications, artwork, branding, packaging and other project details before production proceeds.
7. Inspection and quality disputes
The Buyer should inspect the goods promptly after receipt. If the Buyer believes there is a quality issue, the Buyer must notify Winky Beauty and raise the dispute within 60 calendar days after receipt of the goods. The notice should include the relevant order reference, product details, quantities affected and reasonable supporting evidence, such as photographs, videos or other records. Winky Beauty and the Buyer will review the evidence in good faith and discuss an appropriate resolution for a verified quality issue.
8. Information, brand assets and intellectual property
When you submit an enquiry, please provide accurate business contact details and a clear description of the products, specifications, estimated quantities, destination market and branding or packaging questions you want reviewed. You are responsible for confirming that you have authority to submit any files, logos, artwork, product references or other materials included with the enquiry. By submitting them, you allow Winky Beauty to use them only as reasonably necessary to review and discuss the requested product, packaging or quotation scope.
9. Website use
You may use this website for lawful business research and enquiries. Do not attempt to interfere with the website, submit misleading information, upload harmful files, misuse forms or use the content in a way that infringes another party’s rights. Access may be limited when necessary to protect the website, its users or enquiry records.
10. Updates and availability
Website information may be corrected, updated or removed as product routes and business processes change. We aim to keep the website useful, but continuous availability cannot be guaranteed. If website wording differs from a current written quotation, P.I. or order confirmation, the current project-specific written document controls for that enquiry.
11. Governing law and disputes
These Terms and any confirmed order governed by them are governed by the laws of the People’s Republic of China. The parties should first seek to resolve a dispute through good-faith discussion. If a dispute cannot be resolved, it may be submitted to a court of competent jurisdiction in the People’s Republic of China, unless the applicable written P.I. or order confirmation provides another lawful dispute-resolution arrangement.
